These Terms of Service (“Terms”) govern your access to and use of the services offered by TruConvert, a brand operated by TruConvert, Inc. (“we,” “us,” or “our”), including our website at https://truconvert.dev and our AI-powered automation tools (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to all of the Terms, you must not access or use the Services.
1. Eligibility
You must be at least 18 years old and capable of forming a legally binding contract to use our Services. By using the Services, you represent that you meet these requirements.
The Services are available to both individuals and businesses worldwide, except where prohibited by law (e.g., sanctioned countries).
2. Description of Services
TruConvert provides AI-powered copywriting and automation services that generate, schedule, and deliver marketing content—including emails, ads, landing pages, social posts, and automated workflows—based on your inputs and settings.
Our platform uses fully automated AI systems to:
Analyze your prompts, brand voice, and goals
Generate original marketing copy in real time
(Where enabled) Automate delivery via email or integrations (e.g., through GoHighLevel)
Important: The Services are automated and non-human-driven. While we strive for accuracy, outputs are generated algorithmically without manual review unless you purchase a managed service add-on.
3. User Responsibilities
You agree to use the Services lawfully, ethically, and in compliance with these Terms. You may not:
Submit prompts or generate content that is illegal, defamatory, harassing, discriminatory, or deceptive.
Use AI automation to send spam, phishing messages, or unsolicited bulk communications.
Generate content that impersonates individuals, brands, or government entities.
Input copyrighted, confidential, or third-party proprietary material without proper authorization.
Attempt to reverse engineer, overload, or interfere with our AI automation systems (e.g., via bots, scripts, or excessive API calls).
Use outputs as medical, legal, financial, or professional advice.
Resell, redistribute, or use AI-generated content to train competing AI models without our written permission.
You are solely responsible for reviewing, editing, and approving all automated outputs before publishing or distributing them.
4. Intellectual Property
Your Inputs: You retain all rights to prompts, brand guidelines, and data you submit. We claim no ownership.
AI Outputs & Automation Results: Upon payment, you receive a worldwide, perpetual, royalty-free license to use, modify, and distribute all AI-generated content and automation deliverables for your personal or commercial purposes.
Our Platform: All software, AI models, automation workflows, trademarks, and underlying technology remain our exclusive property.
Training & Improvement: We may use anonymized, aggregated data from user interactions (not your specific prompts or outputs) to improve our AI automation systems. No personally identifiable information is used for model training.
5. Payment Terms
We offer one-time purchases and monthly/annual subscriptions.
Payments are processed securely via Stripe. All fees are in USD.
Free trials (if offered) automatically convert to paid plans unless canceled beforehand.
Refunds: We offer a full refund within 30 days of your first payment if you’re unsatisfied. No refunds for partial months or after 30 days.
You are responsible for accurate billing information and timely payments.
6. Our Rights
We reserve the right to:
Modify, enhance, or discontinue any feature of the AI automation system with reasonable notice.
Suspend or terminate your access immediately for violations, abusive behavior, non-payment, or system misuse.
Monitor usage to prevent fraud, ensure fair access, and maintain system integrity.
Adjust automation limits (e.g., word count, sends per day) based on your plan tier.
7. Limitation of Liability
THE SERVICES—INCLUDING ALL AI AUTOMATION FEATURES—are PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
AI & Automation Risks: Automated systems may produce errors, delays, or unintended outputs due to algorithmic limitations, data gaps, or technical issues. You assume all risk in using automated content.
No Guaranteed Results: We do not guarantee specific marketing performance, deliverability, or compliance outcomes from automated workflows.
No Consequential Damages: We shall not be liable for indirect, incidental, or consequential damages (e.g., lost revenue, reputational harm, campaign failure).
Liability Cap: Our total liability for any claim related to the Services shall not exceed the total amount you paid us in the past 3 months.
8. Termination
By You: Cancel anytime via your account or by emailing us. Access ends at the end of your billing cycle.
By Us: We may terminate immediately for breach, fraud, or misuse.
Upon Termination: All automation workflows stop. Save any outputs you wish to keep—we are not responsible for lost data after termination.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Arizona, USA.
Any dispute will be resolved exclusively in state or federal courts in Maricopa County, Arizona.
You waive rights to jury trial, class actions, or representative proceedings.
All claims must be brought in your individual capacity.
10. General Provisions
These Terms, together with our Privacy Policy, form the entire agreement between us.
We may update these Terms with 14 days’ notice for material changes (posted on our website).
You may not assign your rights. We may assign ours to affiliates or successors.
Our failure to enforce a right is not a waiver.
